I think I know the answer to the problem but I am hoping that I am missing something that has changed. I am working with a Lithuanian lady who came to the UK on 24 April 2006. She worked from her arrival till June 2007, when she has to quit work after being victim of a physical assault which has left her very depressed. The problem is that she did not register her employment with the Home Office.
So, I am wondering whether there is a possibility that she could be exempted from the R2R?

Unfortunately no.

reg 7 of the Accession regs 2004 requires that registeration takes place (for the purpose of reg 8) within one month begining with the date the employment began. However, under reg 9, the employer "shall be gulity of an offence" if the worker needed registeration and was not asked to do so. May be in respect of the assult, if it came from the employer, you could use this to see if there is a compensation coming? if not the employer, then criminal injury compensation may be?
