I've got a client who has been in receipt of DLA HRC and HRM since April 1992. He has now moved to Italy and is living there for the forseeable future. Last year his claim expired (it was a 2 year award) although he did not become aware of this until 3 months after payment had stopped. He then made a claim which has been refused as he does not satisfy the residence conditions. Has any one had any similiar cases? Are there any ways of getting round a break in claim for clients who were in receipt of DLA prior to 1247/92 coming into force?
