tax credits and criminal injuries
Fri 16-Oct-09 01:53 PM

would a payment of criminal inuries compensation affect a clients entitlement to working tax credits?

CPAG handbook states under investment income disregarded that annuity payments under criminal injuries scheme are disregarded but i am unsure how this would relate to a one off payment.

does anyone have any experience of this as its the first i have had this type of query?

I would assume that as long as it is a geuine one off payment and not payments of income rolled up as a payment of capital then it would count as capital and not be taken into account.

If it is a one-off lump sum payment I would assume that it will be treated as capital and, therefore, not figure for tax credit purposes, apart from any future interest received from it

That sounds right. It doesn't look like income.
