Male client refused IS as lone parent on claim made November '09. Basis of decision is stated to be that he does not have right to reside and the fact there is no record of his working/paying NI contributions after 2001 - or of how he supported himself.
In fact client came to the UK in 1995 together with his wife - both Spanish Nationals. She worked continuously from within a few months of arrival and from 2001 when their first child was born, supported her husband and child. Couple separated about two years ago and finally divorced October 2009 - cannot see the divorce as presenting any problem. Ex-partner remains in work. All of the above info has been supplied to DWP and is documented in their sub which I have in front of me.
But the beauty of this case - and the thing I will have real fun with at tribunal (I so hope I get a PO for this one!) - is that ex-partner has worked for the same employer throughout her time in the UK.... Now guess who that employer might be....
