Non-deps with zero income.

I think I know the answer, but it would be good to check it.

Clients; husband is unable to work, couple are claiming IS. Husband's elderly parents, both with disabilities live with them. They are from abroad, have indef leave to remain, applied for NINOs in June and still don't have any, applied for IS in June but have heard nothing. Therefore the parents have no income.
Husbands brother also lives there. He is in his 30's , with a severe mental health problem (seems like he really needs an appointee),indef leave to remain, same situation with NINO and benefit application.

This whole family and 2 children is being kept on my clients' joint IS, Ch Ben, Ch tax cred.That is the sum total of all monies in the entire house.

Local authority is applying two low rate non-dep deductions in respect of parents and brother, despite absence of any income,and administrative delays in NINO and benefit applications.

Now that they have sought our help, we'll sort out the benefits and NINO issues, but can anyone think of a way around the NDDs?

The only way round I see is a DHP application.

If client or her husband qualified for DLA care component then there would be NIL NDDs. Other than that then a DHP seems the only option , as above.
