Enforcing Tribunal decision

A HB renewal was not completed leading to a Tribunal re late renewal. Claimant found to have continuous good cause (has learning disability plus problems with delivery address causing form to go astray) and Council directed to pay HB and CTB. They have since paid both CTB & rent element of HB. However, have not paid the care & support element of the HB (this was Transitional HB before Supporting People came in). The HB and THB were never looked at separately and HB did not Appeal. Have written to Revenues Officer in charge of case & her Manager; solicitor has written threatening court action. No response. Now looking at paying solicitor (& poss barrister) lots of money to go to court. Any experience / ideas...?

As the LA have not appealed to the Commissioners, you have 2 alternatives if you can not get the LA to act.

1) The expensive way would be to sue in the county court. It is a simple debt you are suing for, there is no other legal complexity as far as I can see You can start the process online via the court service website

2) Make a complaint to the local government ombudsman

Transitional HB is still HB in my book!!!
