Cooking Test Request

Hello All

Am a newbie poster here but have been plundering the wisdom for quite some time! (Thank you!)

Could anyone help me with a case reference? I need to argue the cooking test before an appeal panel who are keen on the old slotted spoons/perching stools scenarios.

I am sure that I read a reference somewhere to a case that stated that as the test is one of fact and not law and as one either passes or fails the test it is not within the remit of the panel to suggest aids to ameliorate the situation. If you fail the test, quite simply, you qualify for the cash.

Can anyone help?
