Any thoughts on the following: On 10/10/08 my client was awarded VWF @ 3% from 01/01/85. Loss of faculty is loss of sensorineural function.
We applied for REA. This was refused on basis that: the disease A11 defined as Vibration White Finger (Hand & Arm Vibration Syndrome) was amended from 01/10/2007 to include the loss of sensoneural function. As the definition of this disease is after 10/10/1994, then REA is not payable.
I’m struggling to find any argument against this. Has anyone come across a similar scenario?
