Query re CT - person without R2R

Cli - British woman lives in property with her partner who does not have right to reside (as yet).. As such, he doesnt have recourse to public funds..

She is working, get CB & TCs for her and her 15 yr old son...

She tells me today that she is receiving her 25% on council tax.

Is she eligible for this.. With over 18 partner at address, even though he has no recourse to public funds..

quick answer, NO. single resident discounts dont rely on right to reside, only on actual residence.

Thats what I would have thought..

Wont give you any benefits on the one hand but expect you to pay on the other..

similar issue with non dependant - no recourse to public funds but will Hb be able to take a non dependant deduction?

Cli in this scenario doesnt actually get any HB/CTB... Only single adult discount..

However that is something to consider..

there shouldn't be a non-dep deduction for a partner. see reg 3 of CT regs
