Carers Allowance- Full Time Education

Client is at university - has been on carers allowance - stopped -due to being in full time ed.
The Information I have is : A client will not qualify for carer's allowance if s/he is in full-time education. Full-time education means attendance at an educational establishment for 21 hours or more a week. The hours include time spent on tuition, supervised study, exams and practical projects which are part of the curriculum of the course. Unsupervised study is not included, even if it takes place on the premises of the educational institution. If a client is on a course, s/he will be treated as attending it for the usual number of term-time hours during vacations and temporary interruptions.
Our Client claims that her university study time varies - some weeks she is not there for 21 hours. can anyone offer any guidance? - case law? - I have not covered an appeal such as this so any help would be of great assistance.
