dla and childcare
Thu 16-Mar-06 01:28 PM

I'm interested in teasing out, in plain English if possible (!), 'attention' in relation to childcare for a dla application for my client with back problems, extensive bleeding necessitating anticipated hysterectomy, carpel tunnel, anxiety and depression. She has 4 children, 2 of whom are under 2 years. Am I correct in assuming it has to be attention to enable her to take care of the children eg restraining an excitable toddler for dressing / washing etc - I want to be absolutely sure of the difference between providing replacement childcare ( which won't count?) and enabling the mother to carry out the childcare herself. Would appreciate any signposting to relevant case-law and any other suggestions re the above. thanks.

The following is a link to an article from the April 2001 edition of CPAG's Welfare Rights Bulletin entitled 'Bringing up baby: DLA and childcare' which looks at relevant case law -
