Hi everyone.
Can someone clarify the conditions for continuing to recieve wtc on 'disability'grounds. Client is single man who works 16 hrs a week. He easily qualifies under the 'disability that puts you at a disadvantage in getting a job' test but does not currently recieve one of the listed benefits. The handbook list receipt of long term IB in the 182 days prior to the claim as one of the listed benefits but I am not clear whether TC consider that claiming tax credits continuously for say three years is one claim (as it would be for almost all DWP benefits) or three separate claims on each of the three successive years, even if payment was continuos throughout the whole period.

Hi I believe this has come up before on these discussion pages, so keep scrolling through and you'll find chapter and verse

in the mean-time I refer you to the Disability Rights Handbook from the Disability Alliance. Chapter 12, Page 111 - Condition G. "This should allow those who were getting a qualifying benefit such as I.B. TO CONTINUE TO GET THE wtc DISABILITY ELEMENT FOR LONG AFTER THEY STOPPED RECEIVING THAT BENEFIT".
