j.s.a suspension whilst claim is investigated ...

a very good tail end of the week to all

this could be a bit long winded but ...

i have a cl. aged 24, with learning difficulties, who was in receipt of j.s.a. however, before xmas, he , his father and two uncles were stopped at dover by customs, and when they were all asked what their professions were, the cl. father told customs that cl. was a self-emoployed window cleaner in their co ... (do'h indeed !) this info got back to local jcp and as a result, after cl. attended an interview (not under caution) j.s.a was suspended.

cl. / his mum advised jcp that his father said he was a self-employed window cleaner because they were concerned what customs would say when they were stopped.

we spoke with jcp who stated that cl. needs to go back to customs and explain why they said cl. was a self-employed window cleaner, make a written statement confirming this, and then they will look at cl. j.s.a claim again.

what can i do to get cl. benefit if father won't retract statement because this is still suspended.

sorry if this Q. is very sketchy but any responses will, as ever, be gratefully accepted.

I dont understand why the father would say that but who knows what was going on at the time, all has the faint whiff of fish...

But that aside, write to the DWP and insist that benefit is reinsted or that an entitlement decision is made as soon as possbile. If the decision goes against client then the normal appeal procedure applies. If they refuse and leave benefit suspended for an unreasonably long time threaten judicial review. Can he get hardship payments in these circumstances? Not sure off the top of my head

just thought i'd let you know that i wrote a letter to jcp, and it appears cl. is allowed to submit another claim for j.s.a so thanx for your tip.
