Incapacity Benefit earnings rules
Thu 05-Feb-04 11:22 AM

Can anyone out there help me? I have conflicting information about a client who is to receive holiday pay whilst claiming IB. The CPAG states that holiday pay is income that is considered to be earnings. The DRH says that IB not affected by wages. Any ideas?

Your sources aren't really conflicting - holiday pay is earnings, but IB is not affected by them, only by pensions or insurance payments (defined in subsection 5 of Section 30DD SSCBA 1992); half of it over £85 per week comes off the IB in that case.

As far as I can tell IB claimants can receive their full pay (if their contract allows it and I've yet to see one that does) and IB after the 28 week SSP period.
