DLA middle rate
Wed 22-Feb-06 11:35 AM

I am new to the field of Welfare Benefits so would appreciate any help/advice. I am helping a client who is already in receipt of DLA care low for mental health issues, I would like to seek a review of this to the middle rate because of her condition, what advice can anybody give me? The lady I am helping has taken an overdose again and has a history of this and has been admitted to various hospitals and is seeing numerous agencies, none of which appear to talk to each other, I'm trying to get hb sorted as this lady is working and is really trying to help herself, and I think the extra income would help ease pressure, what the best way to go about this?

The middle rate of the care component is only payable if the cl requires frequent attention throughout the day or continual supervision.
You could argue continual supervision is required because of history of self harm but one difficulty you may have is the fact that she is working. If her employer/line manager is aware of her mental health problems and the risk of self harm and does keep an eye on her/supervises her more than her colleagues then you can argue continual supervision. If she has a care plan from the CMHT or psychiatrist then you can use that to show a need for supervision to avoid self harm.

As you are new to welfare benefits I suggest you click on the "Swopshop" area and look at the Mental health & benefits - 'The Big Book'
