Incontinence/IBS
Mon 15-Mar-04 10:53 AM

We have recently taken on a case which is due to go before Commissioner May at the end of this month. We know that he is intending to revisit the decision by Commissioner Goodman regarding incontinence in terms of 'urgency'. We are confident that he will be attempting to change this decision to the detriment of our clients.

We are therefore researching every possible decision which backs up Commissioner Goodman's arguements for 'urgency'. Even May himself has referred to Goodman but something or someone has obviously rattled his cage and we have a bad feeling about the hearing.

Any help (in terms of relative decisions or arguements) would be greatly appreciated.

'nevip' gave a reference for a Comm. decision last May CDLA/1361/99
dealing with bowel incontinence in relation to severe discomfort for HR Mobility.
If you already have that decision could you let me have a copy because I have not been able to find it.
Thanks
