Don't know if this helps but the enabling legislation for EMAs is s.518 Education Act 1996.

Ah, but the 2001 reg revoked the 2000 regs. So in short....I dont have clue.

Sorry, what I can't work out is what replaced the regs after 2004. Maybe there is some other bright spark out there that can help!

The answer I was looking for is in the 2000 Regs. It is highly likely that in this particular instance the prevailing Regs would be the same. I could do with checking though, if anyone knows where I can find them.
