I've just come across someone who has submitted an IS claim and has mortgage costs taken out since Oct 1995. His wife claims CA and my understanding is that carers can receive housing costs after 8/26 weeks under the pre-1995 rules. However, the regulation (Sch 5 para 8(2) IS (Gen)Regs) only refers to the claimant being the carer. I can't find any commentary that states categorically that it doesn't apply when the partner is the carer and I don't want to suggest swapping claimants if it isn't necessary. Can anyone clarify this?
