tribunal's rights to make decisions on official error

There is a decision that sets out clearly (rather than just hinting at) the right of tribunals to make decisions under reg. 3(5)(a) D&A regs. Can someone remind my poor addled brain of the ref of the decision & supply a copy?

Is it CDLA/1707/2005?


A copy is available on rightsnet (from Tool kit hit commissioners decisions and then "Commissioners decisions on rightsnet") (although the actual decision was later very slightly amended and therefore I have asked Shawn/Ken to upload the amended version).

Just read the decision. Thats a nice case to win and, I presume, an enjoyable one to argue. Your arguments were clear and cogent and the commissioners reasoning was impeccable. Well done mate!
