Overpayment of SRP: failure to disclose
Wed 24-Oct-07 12:29 PM

My client has an overpayment of the dependent's addition of SRP. Was paying it to his estranged wife but got divorced and did not realise that the addition was for her and not the children, so did not report change. Is there a more relevant CD re what he was required to disclose than CDLA/179/2007 which concerns change in care and mob needs? He has no recollection of being told what to report, the award notice simply says it was a dependent addition (not adult dep) and the same notice says he must report changes such as going into hospital, but nothing more.

Incidentally, he has not received a decision notice, only a demand for payment followed by an explanation of failure to disclose. It is therefore unlikely that the decision has been correctly superseded.
