hello....
i need some advice regarding Disability Premium.
Basically i have a client that is under 60 and has been on War pension since 1998. He left due to sustaining injury while he was in the Army. He is currently on JSA. According to the CPAG book p886 my client would qualify for disability premium if: he/she recieved a qualifying benefit:- One of the criteria is:
(1) if you are recieving DLA or a qualifying benefit paid to meet attendance needs because of an injury at work or a war injury
(2) war pensioners mobility supplement
etc etc
My client does not recieve anything for mobility as he has been assessed at being able to walk about 400 yards within 5mins!!!
Anyhow client does not recieve any other benfits....
I have tried to find something in law to support this statement that has been written in CPAG. However, in doesn't seem to be in the regs! maybe i have missed something. If anyone has come across anything similar and has argued this please let me know.....
