I have a case going to appeal on monday 11 October and would be grateful for anyones help. I have a client (who has sadly now passed away) that suffered from alcoholisium, liver failure, nerve ending damage etc. A EMP called in September 2003 and basically stated she could do everything without help. This decision was challenged and another EMP called in January 2004, and found she needed help with most things. The DBC decided to contact their medical services who stated her condition would not have deteriorated so fast and therefore preferred the first EMP report. Can anyone supply me with the regulation with regards preferring EMP reports. My client has since died due to liver failure and I have been asked to pursue this case so that any further award can go to the estate for her 11 year old daughter.
