responsible for no recourse cousin's children

Client looks after cousin's children Monday to Friday. Cousin has outstanding immigration application and no recourse to public funds. Is client entitled to child tax credits/ child benefit for the children?

A person 'subject to immigration control' has no recourse to public funds. Child benefit and child tax credit are both 'public funds' for this purpose.

Is your client subject to immigration control? Although, unless she is legally responsible for the children, I don't think even that would matter.
