Hello

Claimant and two <10 children thinking of moving - to become joint tenant with friend. 2 storey dwelling, the other tenant will have exclusive use of 1 bedroom, living room and a bathroom on 1st flr (he's not claiming - so he's out of all this), claimant will have exclusive use of 2 bedrooms, 1 living room and a bathroom - all on grd flr. Kitchen (I'm assuming on grd flr) will be shared. Global rent £800.

She's below her applicable amount, so assuming no LTAHW issues, and rent share of £400, shouldn't she get the 2 bed rate, ie 400 plus up to £15/week over?

What difference will it make if, for example, the 2 tenants agree that claimant will pay 2/3 of the rent (seeing she has 2 beds and joint tenant has only one?)

What I'm getting at here, in general, is: Does the 'exclusive use' of 2 rooms mean that claimants will be out of the sharing rules and get their room requirement?

Yes (ish)

Depending on the actual Lha rate for 2 bed propertys in the Brma at the time of claim/tenancy.

Have a look at the example in the Lha guidance manual; Bob and Alice I think.
