I'm pursuing a case where an overpayment has arisen in 2006/7 due to an annual declaration not being returned for 2005/6. My client was in a joint claim in the period covered by the overpayment and in 2005/6. Neither person in the claim returned an AD as the request never arived.

As well as attempting a late AD, I'm trying to find a basis for arguing that the TCO shouldn't recover via a complaint. So far they are saying there was no error on their part as the request for a annual declaration was issued but not returned.

It seems pretty fishy to me that neither person in the joint claim received anything, and I've done a DP request to see if it turns up anyting. But also I recall reading previous posts here along the lines of ... "and it's well know that on 13 July 2002 the computer went down and nothing was sent out that whole day" (made up date). So I'm asking, are there any known problems with ADs this year?
