I have a service user with cystic fibrosis. She gave up full time work on medical grounds some years ago and was able to work parttime under the old Theraputic Earnings rules. When PE came in she was allowed to receive it for a while and then was told she had no entitlement as she did not have a support worker, and therefore did not need support. She argued she had been told that some regions allowed job brokers to forfill that role. She was told that BS staff cannot be support workers. She says she has tried and failed to get a support worker. She did send a letter of support from a cf social worker who said that she gave support although it had become intermittent, and by phone, after initially a lot of personal contact. This was not accepted and she is going to tribunal. Any advice as to what she can argue? Any Commissioners decisions?
