An additional point worth noting: the Commissioners in Scotland are staying look-alike cases pending the outcome of Gillies. I see no reason why exactly the same approach should not be followed by tribunals. So if you raise a point of bias of a medical member at a tribunal hearing, the tribunal should adjourn if they agree that the point is the same as Gillies. This could of course result in indefinite delay, but it could also be argued that it would be a fairer use of time to reconvene a tribunal without a medical member connected with the DWP.

The appeal by the DWP in Cunningham is to be heard at the Court of Session on the 8th and 9th of July. Tribunal has an EMP report before it and the Chair of the tribunal has previously sat with the EMP who gave the report as a wing member.
