ICB and moving to France
Fri 13-Feb-04 09:37 AM

Claimant in early 60's who has been on ICB for about 3/4 years. Doesn't receive any other benefits. Later this year he is going to move permanently to live in France. My understanding is that he will remain entitled to ICB as long as he satisfies the 'normal' conditions of entitlement. Is that correct? PCA - in my experience when someone is living in France and becomes subject to this the DWP usually arranges for a report from a local doctor. On occasion I have heard of them insisting that a report is obtained from a UK doctor. Anyone know how common the latter is? Thanks.

Warn your client to be careful.
People moving to nicer climates have been known to experience improvement in their condition such that they no longer qualify. Although its nice to get better, when claimants'financial assumptions are destroyed its bad enough if they are still in the UK. If they are abroad at that stage they can have a really tough time.
Don't know about the frequency of UK rather than local medical examinations, though.

If client has to appeal a failure of PCA he will then need to return to the UK and usually try and claim IS and then fail the habitual residence test ? One case of that locally with a client having to return from Spain. Not that I want to deter anyone going to live in France, bien sur.
