Disabled worker route to WTC
Tue 26-Jul-05 04:55 AM

Please can you look at this case for me and let me know if my thinking is correct.

Couple, Mrs working 20 hours a week. Mr retired.

She used to work 36 hours a week but last Sept went off work sick due to operation and got SSP.

Returned to work Feb of this year but on reduced hours.

She would pass the 'disability test' but not sure about the qualifying benefit test.

No DLA in payment - no other benefits other than SSP in payment.

She was on SSP for 140 consectutive days,
She is still recovering from the op and unlikely to be able to return to full-time work for at least 6 months, and
Her earnings have reduced due to her hours reducing due to disability.

So these look OK ??????

But am I right in thinking that SSP must have been in payment within 56 days of claim - SSP ended in Feb. However if she makes a claim today and can have this backdated 3 months, and if this is treated as the date of claim (see my other posting today) she may just qualify - but we may be a few days too late (if we are is there anything we can do??).

Thanks
