I am currently assisting a lone parent who has receivied a summary warrant for Council Tax arrears for the year 1998/99. The woman was living with her friend at the time, and there was a dispute regarding the amount of Council Tax that they owed which was never resolved at the time. The woman never heard anything more until a few months ago when a letter was sent to her parents address. When I contacted the Benefits Ofice they told me that they had no longer any papers going as far back as that year. Nevertheless, the Collections Office are pursuing the amount.

Is anyone aware of whether this can be challenged as it is no longer possible to ascertain the exact amount owed. Further more the woman who shared the flat can no longer be traced and they are trying to get the full amount from my client.

I think you could run an HRA challenge under Article 6 (Right to a Fair Hearing)
