hi guys
i have a client that has basically got an overpayment of about £215.15. The DWP have stated that she failed to dosclose that her partner had left home and continued to claim for herself and her partner.
Clients arguments are that she does not understand english and did not know she had to inform department of this. Also she did not know that she was receiving income support for herself AND her partner?
Any caselaw you know of would help to argue the fact that client did not know english? DWP are using the cis/124/1990 case against us? has anyone got one to counter this?
