Backdating Carer's allowance
Mon 05-Sep-05 02:20 PM

Hi all
When Carer's allowance is stopped due to the rate of DLA being reduced but the higher rate of DLA is subsequently reinstated, how hard is it to get full backpay of Carer's allowance, i.e. to get more than 3 months worth of backpay?
Cheers
Michelle

I've never had a problem. Don't think it's even necessary for a new claim form, although that may have changed. If you do need new claim form just put in covering letter explaining DLA reinstated and no break in award following reconsideration/appeal.

It is not a backdate. It is a revision on the basis that the decision was based on a mistake to a material fact. i.e. the dla should not ahve stopped so entittlement to CA technically never stopped. They usually ask for a new form as there may have been a change of circs if several months have passed
