Reduced Rate Income Support pending appeal

Hi there - It has always been my understanding that you can receive redcued rate Income Support until the final determination of an appeal - including Commissioners cases- since our new Jobcentre Plus Office has opened with staff from other areas we are getting mixed reactions to this and today I have been told that this should never be the case - I have quoted Para 25 of Schedule 1 of the Incoem Support regs and Commissioners Decision CIS2654/1999 - I am waiting on them getting back to me but just wondered if anyone else had come accross this situation. Yes we battle with this a lot.

We get one supervisor at the local office understanding the correct way to do it then they leave and we have to start again.

An appeal is not determined until it has been taken as far as it can go - it should be enough that your local office check with TAS that leave to appeal has been requested and IS at the reduced rate should be put back in to payment until such time as the appeal is determined.

Thanks for that - fortunately I have just had a message left on my phone from the Decision Maker confirming they accept they are wrong and will reinstate benefit immediately.
