[2022] EWHC 123 (Admin)
Anybody aware of whether DWP is doing anything in response to this case that found failure to provide protection for loss of EDP upon natural migration to be discriminatory
https://www.rightsnet.org.uk/welfare-rights/caselaw/item/high-court-rules-that-failure-to-compensate-claimants-who-migrated-to-universal-credit-for-loss-of-enhanced-disability-premium-and-child-tax-credit-disabled-child-element-is-unlawful
I think you are asking about TP (No. 3) [2022] EWHC 123 (Admin).
I’m not aware that there has been any formal announcement on what is to be done in view of this decision. I expect it will take quite a while longer yet and the DWP (given it’s belligerence on this issue) will probably be looking to appeal this decision too, as it did with TP Nos 1 and 2 - its appeal being refused under the citation in your heading.
Thanks, Elliot. You’re right, that is the case (I copied the wrong title, I’ve now corrected it).
Your comments are what I expected!
