LHA for caravans
Mon 06-Apr-09 10:54 AM

A colleague has rung me to ask if the LHA for a rented static caravan is any different to the LHA for a similar sized flat or house. The LHA website doesn't seem to make any distinction between types of dwelling, just the number of bedrooms. Sch 4 of the Rent Officers (HB functions) Order 1997 just says that no references should be made to size criteria, can we therefore assume that an LHA level at the rate for I bed, Self Contained would be made?

Any help from the HB experts out there gartefully recieved!

LHA does not cover caravans, they are exempted from the LHA by, if I recall correctly, Reg 13D (5)(d)

Thanks for that , it's actually 13C (5)(d) but without your info I would probably not have looked there.

Can anyone think of an interesting, original or amusing reason why HB is payable on caravan site rental, but you have to claim DWP benefits for the site rental on your tent?

What would a trailer tent qualify for? HB, IS or both?

I feel a caravan load of upper tribunal cases coming on here. Perhaps someone is intent on bringing them as we speak
