I am wondering if anyone has heard of their experiences when they are found unfit for work but have failed to meet the criteria for the support group.
how are clients finding this new "support"?
the reason I ask is that I have a client who i represented at appeal. he was found to have limited capability for work under reg 29b but not limited capability for work related activity.
this man is seriously unwell and i have no doubt the support group should have applied. we are considering challenging the decision as the tribunal was a farce with the chair being unaware of reg 35 until i pointed it out to her so i am confident we can find an error of law.
the client though is very anxious given i cannot guarantee him the outcome of any new trbunal.
Over and above the fact he will be paid less by not getting the support group how concerned should i be about this guys contact with jcp following the decision?
