Client claimed JSA on 07-10-08. JCP processed claim for CBJSA. JCP refused CBJSA on 15-11-08 because of insufficient NI cons. JCP did not issue JSA3 for IBJSA until 28-04-09. Client is entitled to IBJSA from this date. JCP will not pay IBJSA from 07-10-08. JCP state that they do not automatically treat a claim for CBJSA as a claim for IBJSA where client does not qualify for CBJSA. I have checked CPAG and DMG and cannot find anything on this. Is JCP correct? Client has been told to request backdate, but even if successful IBJSA can be only be backdated three months, not to 07-10-08.
