IS and trust funds.

I have a client who is on IS and holds a trust fund for her disabled child. The client is worried that if she breaks into the trust fund to make repairs to her home for the child or to take her on a family holiday would this have any bearing on her IS entitlement.

The client also wanted to know what happens to income support if she just lets the money continue to grow in the trust fund is there any point that this would be taken into account as capital for IS purposes,

I had talked to the local IS depart about the above about they just stated that it would have to go to a decision maker but I an looking for some point of authority that I can show my client as she is anxious about her situation.

1 It shouldn't

2 It should still be considered as a part of the trust fund
