how to calculate the 1month/13 month time limit

Hello

Under regulation 32 SS & CA(DA) regs there is an absolute time limit of 13 months.

If a decision notice is dated 20th January 2009 do you start calculating the one month/13 month time limit from 21st January 2009?

Does anyone know of any case/provision which helps determine how time limits should be calculated?

Thank you very much!
