Leaving work & JSA (CB)
Tue 27-Jan-09 01:17 PM

Watch out for this happening in your area.

Over the last 3 weeks we have seen 8 people who have contacted the 0800 0 55 66 88 claim number many weeks ago to claim JSA (CB) only to be told they are unable to claim due to pay in leiu of notice and holidays being paid.

In one case they contacted them on 24/11/08 when they were paid off with 12 weeks notice, they were told phone back in February?

They have now claimed and being paid JSA (CB) due to the information we gave them, but they have not only lost out on the JSA (CB) at £60.50 weekly, but they also have income protection for their mortgage and another loan so have lost the benefit of this as well.

It seems they have been awarded credits when they asked for full backdating to November due to the incorrect advice given, but no JSA or compensation.

At a time when people most need the help and support to find out the DWP are getting it so wrong is worrying!

i shudder to think how much benefit entitlement people lose to the 'informal and unaccountable' gateway keepers... and generally by not training staff properly...

somebody said "enlightenment is mistake after mistake..." the human race must be due a breakthrough any day...

Have you appealed against the backdating refusal? Is it clear that backdating of benefits has been asked for? You would be within regulation 19(5)(d).

Why do you think you've had so many all of a sudden?

So many have been paid off lately, many have not claimed anything ever so hence the large increase, we deal with people from all over the UK.

Local MP is now involved, we have sent two people effected to see them after we mentioned the problems earlier so hard evidence is available to them, one person was none to happy in missing out as their mortgage protection and a personal loan protection policy were all dependent on them claiming JSA.

MP has said it has now been raised with the local JC+ office, training at local JC+ level is being arranged with a memo to the claim line, seemingly.

Backdates have been requested and credits paid but JSA (CB) money so far refused.
