I have several clients who have appeals pending, from first-time WCAs. They are being actively pursued for sick notes in order to keep receiving ESA at the assessment pariod rate. Is this right? My understanding is that sick notes are only necessary to support a claim up to the time of the ESA assesment.
Yes, clients do need to keep sending in sick notes whilst WCA appeal pending. The disallowance has already 'confirmed' client is fit for work & therefore the client needs to provide evidence that they are unable to work.
