Hi

I know there is guidance on unaccompanied asylum seeking children claim benefits at age 18, but I dont know where it actually comes from. Can anyone point me in the right direction for the DMG or regs please? I am just about to try my first claim, and want to make sure I can quote regs is queried. Also the asylum support team in this area have told me that my guidance is incorrect. I dont think it is, but would also like to point them in the direction of the regs.

Hi,

You could try the Home Office information notes on unaccompanied asylum seeking children, specifically Part II(21) which relates to: Entitlement to support at age 18.

A young person leaving care is recognised as needing ongoing support beyond the age of 18, therefore the LA should be looking at an ongoing care package when the unaccompanied asylum seeking child reaches 18.
