what to claim while appealing living together decision Fri 13-Mar-09 10:42 AM
situation is client has had decision that her and boyfriend are living together as couple so income support has been ended. boyfriend has other address in another city where all mail etc goes so i am hoping the actual appeal wont be a problem.
the issue though is what should i get her to claim in the meantime. the boyfriend works so his income would mean no benefit entitlement. client has two children one 17 and one 12 who she gets child benefit and tax credits for.
would jsa be the best bet and then ask for hardship payments should they refuse the claim? i am thinking this may be best as client will soon need to claim this anyway given the age of youngest child.
is though there any chance of payments through is either with claim that has been shut or the existing claim? i cant seem to get a definite answer to this.

I usually suggest he/she claims again as a single person. The LTAHW decision was made on a specific date and is under appeal so she can reclaim and that claim will be treated on it's own merits. It doesn't seem to constitute any admission that prior to this she was LTAHW. It's always worked for me!
