Appeal for Income Support - couple NOT a couple

Hi there
Have an upcoming appeal - client has been "found" by IS to have been living with a couple from 2004 -2009 in March this year. They have come to this decision becuase the father of her 2 children uses her home (the mortgage is in his name and he pays it) for his bank account and for a personal loan.
They have never lived together in this house - he has provided proof that he's lived elsewhere, they've both been interviewed etc.
If anyone is aware of any caselaw or legal arguments to back up the client, please can I have them!
