IS award ends - backdate WTC claim? Fri 19-Dec-08 01:58 PM
Not sure whether to post this in IS or TC forum but here goes:
Client started work on 10th October 2008 but is currently in receipt of SSP – has been sick since 12th November 2008. He has claimed IS and is awaiting decision on this claim. It is likely that he will return to work shortly.
He also meets the criteria for an award of WTC - if he waits until his return to work to make a claim (and asks for the three month backdate) how will the IS award interact with the WTC award?
If WTC arrears are treated as capital then he gets paid twice for the same period – I am struggling to see if this scenario would lead to a recoverable overpayment.
