There are 3 adult children all having the same mother, 2 and 3 have the same father and 1 has a different father. Who is legally the next of kin between 1 and 3 if number 2 dies? No 1 is the eldest.

I was always under the impression that next of kin was a personal choice and not dictated by law (could it maybe a sibling, partner etc).

The next of kin for a child remains the parent or guardian until the child reaches 18, after that it is a matter of choice. If you are looking at Wills and Probate there are specific rules regarding who can inherit
