R2R for polish national

I wonder if i am missing something really obvious here and if i am if someone could please point it out to me.

I submitted an appeal recently to Wick for a Polish national who has been refused JSA. He has worked for 12 months in registered work (it is only just over 12 months i admit but is over). We appealed and provided evidence of this and Wick have written back saying they have reconsidered but not revised and are sending to Tribunal.

I thought this was a fairly easy appeal, he's completed 12 months registered work so he can sign on for 6 months no problem. Am i missing something?

Was the application to WRS received within the first month of starting the job?

The certificate is dated 18/09/06 for job start date as 15/05/06. Thats not within one month but i think he did make application in time?

I think it has to be received by WRS within the month for it to date from the job start date. I could be wrong though.

Otherwise it dates from the issue date.

Because this was his first registration he has both certs. First one says date of issue 18/09/06 and second one same date but confirms job start date as May. Does that mean if it wasnt issued on time that he wont get JSA? As I said in my original post he only made one year by a few days so if it starts in Sep will he not qualify for JSA?

The certificate is valid from the issue date of the certificate. The 12-month qualifying period for residency status begins on the date that legal employment begins.

If a person does do not apply within one month of starting a job, the employment will be unlawful after that date. It will then be unlawful until they are issued with a registration certificate. Any time spent working unlawfully will not count towards the 12-month qualifying period.
