LTAHAW - DWP internal guidance
Fri 03-Jul-09 01:36 PM

I'm anticipating problems with a LTAHAW case, where ex-husband has moved in with ex-wife whilst undergoing chemo-therapy. It's as clear-cut a case as can be, with a 12 week chemo treatment, separate residences being maintained, then going separate ways. Ex-wife has long standing MH & substance misuse issues. JC+ want to visit, so I'm wondering, has anyone out there got an electronic version of the DWP LTAHAW internal guidance that they could email me? I want to be there when the officer visits, with the guide in my hand.

Thanks.

Hi Rob,

I don't have a personal copy of the DMG in respect of LTAHAW but the DWP link/address below should be what you are looking for. When you get to the page scroll down to: Volume 3, Chapter 11.

http://www.dwp.gov.uk/publications/specialist-guides/decision-makers-guide/

Good luck,

Thanks Chaos, but it's their internal guidance I was after, not the DMG. After Civil Partnerships were brought in, the LTAHAW/CP guide was re-written and became difficult to get hold of. I'm seeking the procedural niceties, not the regs, because I want to make sure that the individuals concerned are handled correctly. I'm already hacked off that, despite the information I've provided about their respective health situations, that the client has been upfront about the change in circumstances and reported it at the correct time, that I have provided JC+ with a CD parallelling the domestic set-up and, indeed, referred them to the DMG Chap 11 re temporary arrangements, the JC is still going to send out a visiting officer, for what I feel is a waste of time. Ironically, I was trying to prevent a tie-up of both my time and that of the JC+ by providing all the necessary information for a DM to come to a favourable and sensible decision. I just hope the other person's DLA claim doesn't turn into a DS1500 case.
