hello again all...

client was on Income Support from 2000 until January 2008, when she reported the fact of her marriage, her husband having moved in to live with her at the end of December 2007

she was in fact married in October 2007 abroad, but she and her husband came back from the wedding and went their separate ways from the airport, having had a massive row whilst away.

she of course knew she had to report if she started Living together, and did so as soon as they were ...

you can see where this is going.

What are the prospects of maintaining her entitlement to IS for the period between marriage and cohabitation starting?

separately, the DWP also insist he was living with her from 2002, but that's a whole other ball game which i am addressing by obtaining positive evidence to the contrary.

I suspect that you already know the answer to this. It all depends on whether the separation, from all the known facts, including their intentions from day to day within the period, could be classified as permanent or temporary.
