Comprehensive sickness insurance - what counts for right to reside purposes?

I have received a statement of reasons where the Chairman seems to have been persuaded that the claimant could be regarded as self sufficient but was not persuaded by the argument advanced by CPAG which suggested that having an E111 (or equivalent) could be deemed to constitute an EU citizen having 'comprehensive sickness insurance'. Has anybody got any useful precedent or ideas regarding this.

There was an earlier thread on this subject in August but it went a bit off topic rapidly. Any assistance with this now would be most welcome.

Did you try appealing to UT on this Kurt, and if so did you get a decision on it? Or has anyone else come accross anything that sheds light on the issue?

It is currently with the Upper Tribunal and a decision is awaited.
If it is true that 'Your EHIC will allow you access to the same state-provided healthcare as a resident of the country you are visiting' (as the EHIC website suggests) and 'The NHS provides a comprehensive service, available to all' (as the NHS constitution announces) then could it be reasonable to assume that any European citizen able to access a EHIC could be regarded as having 'comprehensive sickness insurance'? Constructive criticisms of this logic would be welcome.
